Terms and Conditions

By using the Hash 34 platform ("Service"), you agree to be bound by these Terms and Conditions. Please read them carefully.

1. Nature of the Service

Hash 34 provides a digital environment for users to record, timestamp, and store evidence of brand assets (names, logos, slogans) to assist in establishing "prior use."

  • Not a Law Firm: Hash 34 is a technology platform, not a law firm. We do not provide legal advice, legal opinions, or trademark prosecution services.
  • No Guarantee of Rights: Using Hash 34 does not grant you a registered trademark. Formal trademark rights are granted by government bodies (such as the USPTO or CGPDTM) upon successful application and use in commerce.

2. User Responsibilities

  • Accuracy of Data: You are solely responsible for the truthfulness of the information and "First Use" dates you provide. Hash 34 does not verify the authenticity of your claims.
  • Account Security: You must maintain the confidentiality of your login credentials. You are responsible for all activities that occur under your account.
  • Eligibility: The Service is intended for founders and startups. If you are under 18, you must have parental or guardian consent to use this platform.

3. Intellectual Property and Ownership

  • Your Content: You retain all ownership rights to the assets (logos, names, etc.) you upload to Hash 34.
  • Our Platform: All software, design, and branding associated with Hash 34 are the exclusive property of Hash 34 and protected by intellectual property laws.
  • Limited License: By uploading content, you grant Hash 34 a limited license to store, timestamp, and display that content back to you or to third parties only as directed by your privacy settings.

4. Evidence and Certification

Hash 34 generates a "Statement of Record" or timestamp based on your input.

  • This document is intended to serve as supporting evidence of your claim of first use.
  • Hash 34 makes no warranty that this evidence will be admissible in court or sufficient to win a trademark dispute.
Hash 34 provides a record of evidence as-is. We do not guarantee that this evidence will result in a successful trademark registration or legal victory. The user pays for the act of verification and digital timestamping, not for a specific legal outcome.

5. Prohibited Uses

  • Claim rights to trademarks or assets that you know belong to another party (Bad Faith).
  • Upload malicious code, viruses, or illegal content.
  • Interfere with the security or integrity of the Hash 34 timestamping protocol.

6. Limitation of Liability

  • Any loss of intellectual property rights.
  • Damages resulting from a failed trademark application.
  • Direct, indirect, or incidental damages arising from the use or inability to use the platform.
  • Service "As Is": Hash 34 is provided on an "as-is" and "as-available" basis without warranties of any kind.

7. Termination

We reserve the right to suspend or terminate your account if you violate these terms or engage in fraudulent activity. Upon termination, your access to stored evidence may be revoked according to our data retention policy.

8. Verification Integrity (The "Matching" Rule)

  • Identity Discrepancy: Hash 34 reserves the right to reject any claim where the name on the Aadhaar Card or MSME Registration does not exactly match the name on the submission.
  • Forfeiture: Failure to provide matching documentation within 7 days of submission may result in the claim being marked as "Unverified" without a refund.

9. Indemnification

You agree to indemnify and hold Hash 34 harmless from any legal claims, damages, or costs (including lawyer fees) arising from your submission of fraudulent documents, trademark infringement of others, or misuse of the platform.

10. Limitation of Liability for Data Breaches

In the event of a data breach or "digital theft," Hash 34's total liability to the user shall be limited to the amount paid by the user for the service in the 12 months preceding the event.

11. Right to Audit

Hash 34 reserves the right to request additional evidence of "use in commerce" (such as invoices, social media links, or website screenshots) to maintain the high standard of our verification database.

12. Governing Law

These terms are governed by and construed in accordance with the laws of West Bengal, India, without regard to its conflict of law principles.
